By accessing or using the Homyxa platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Definitions
- "Platform": refers to the Homyxa website, mobile applications, and all related services.
- "User": refers to any individual or entity that accesses or uses the Platform.
- "Builder": refers to property developers, construction companies, or individuals who list properties for sale on the Platform.
- "Buyer": refers to individuals or entities purchasing properties or property shares through the Platform.
- "Property": refers to real estate listings available for purchase or investment on the Platform.
- "Share": refers to fractional ownership units of a property available for purchase.
User Accounts
To access certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized access to your account.
- Accept responsibility for all activities conducted through your account.
Property Listings
Builders who list properties on the Platform agree to:
- Provide accurate and truthful information about properties.
- Have proper legal authority to list and sell the properties.
- Comply with all applicable real estate laws and regulations.
- Update listing information promptly when changes occur.
Transactions and Payments
All transactions conducted through the Platform are subject to the following terms:
- Buyers must complete payments through approved payment methods including bank transfer, credit cards, or cryptocurrency.
- Homyxa facilitates transactions but is not a party to the sale agreement between Builders and Buyers.
- Transaction fees and commissions are clearly disclosed before purchase confirmation.
- All cryptocurrency transactions are subject to network fees and processing times beyond our control.
Fractional Ownership
For fractional ownership investments, the following additional terms apply:
- Share purchases represent a percentage of ownership in the specified property.
- Dividend payments are distributed quarterly based on rental income and property performance.
- Shareholders have limited voting rights on major property decisions.
- Shares may be sold or transferred subject to platform approval and applicable fees.
- Property performance is not guaranteed, and investments carry inherent risks.
Payment Methods
We accept the following payment methods:
- Bank transfers (SWIFT, local transfers)
- Credit and debit cards (Visa, Mastercard)
- Cryptocurrency (Bitcoin, Ethereum, USDT, USDC)
- All payments are processed securely through verified payment gateways.
Refund Policy
Our refund policy is as follows:
- Property purchases may be cancelled within 14 days of payment, subject to a cancellation fee.
- Fractional share purchases are non-refundable after the 14-day cooling-off period.
- Refunds for cancelled transactions will be processed within 30 business days.
Limitation of Liability
Homyxa acts as a marketplace facilitating real estate transactions. We are not responsible for the quality, legality, or accuracy of property listings. Users engage in transactions at their own risk. Our maximum liability is limited to the transaction fees paid to the Platform.
Dispute Resolution
In the event of disputes:
- Parties agree to first attempt resolution through good faith negotiations.
- If unresolved, disputes will be submitted to mediation before legal proceedings.
- All disputes shall be governed by the laws of the United Arab Emirates.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Users will be notified of significant changes via email. Continued use of the Platform after changes constitutes acceptance of the modified terms.
